Estate Litigation
Estate litigation generally includes challenging the validity of a will, applications to modify wills or trusts, claims against an estate, breach of trust actions, undue influence claims, interpretation of wills, appointment or removal of trustees or other fiduciaries, passing of accounts, probate and administration and all related interested proceedings.
Heirs may dispute a will based on the level of mental capacity of the deceased at the time the will was created. When mental capacity is questioned, the estate must prove that the deceased had the mental capacity to create a valid and legal will.
